The Cantabria Prosecutor’s Office has requested that the 15-year-old adolescent investigated for the death of his adoptive mother in Castro Urdiales (Cantabria) be provisionally detained for six months, after appreciating that “there are indications that it was perpetrator of a crime of murder”.
As sources from the Public Ministry have informed EFE, the Prosecutor’s Office has taken a statement this Thursday from the minor, who was arrested this morning along with his 13-year-old brother, after the Civil Guard found his mother dead in a garage.
The Prosecutor’s Office has made its report available to the Court of Guard, acting as Juvenile Courtrequesting that the precautionary measure of confinement in a closed regime be adopted for six months.
The 13-year-old boy, who is not responsible, has already been admitted in a child protection center at the request of the Public Ministry. This is one of the most notable points of the Organic Law of Criminal Responsibility of Minors. This rule dictates that the minimum age to be sent to provisional prison or serve jail sentance is 18 years old, although minors can also suffer other types of retaliation for committing crimes.
Minors under 14 years of age, such as the case of the second child of the woman murdered in Castro Urdiales, are not subject to imputation, therefore, according to the aforementioned law, It is their parents or legal guardians who must respond for their actions. Furthermore, it is established that the Juvenile Prosecutor’s Office is the body in charge of assessing their situation and making decisions to ensure their protection. In this case, the person allegedly involved in the Castro Urdiales crime has admitted to a juvenile center.
